Information and Fees for Buyers/Bidders

1) Prices: Estimated prices represent the lowest and highest bid expectations of our experts.

2) Written bids: You can place written bids. Enter the catalogue number and your maximum bid for the work of art you wish to buy. At the auction we will bid for you up to this price. You will receive the requested item at the lowest possible price.

3) Telephone bids: You may also participate in the auction via telephone. In this case, written notification shall be sent to the auction house at least one day before the auction takes place. Such written announcement shall contain the item and the catalogue number, as well as the bidder’s name, address and telephone number. The auction house shall make every effort to provide the telephone connection in the best possible manner, but will not assume any warranty for its execution.

4) Bids by a Broker: If you tick the box “By a Broker” on the order bid, we will hand your bids over to a Broker. If two bidders make the same bid, the bid by the Broker takes precedence. A Broker fee of 1.2% of the highest bid is due in addition to the purchase price. Please send your order bids in time by fax (+43 1 532 42 00-9) or email (office@imkinsky.com).

5) Online Bidding: You can also participate in the auction online. Your bid will be handled as if it came from the auction room. Simply register at auction.imkinsky.com by clicking on “register” and you will receive a confirmation email. You will be able to bid as soon as we have processed your application.

6) Invoice: Your invoice will be issued based on the data you have provided. Also, if you have a VAT-ID number, please tell us before the auction.

7) Purchase price: The purchase price is composed of the highest bid and the buyer’s commission.

Buyer’s Commission:

Subject to differential taxation the buyer’s commission is on the hammer price up to € 500.000 30%

on the part of the hammer price in excess of € 500.000 up to € 5.000.000 25%

on the part of the hammer price in excess of € 5.000.000 17%

including 20% sales tax

Subject to normal taxation (marked with “▲” or intended for export to non-EU countries)

on the hammer price up to € 500.000 25%

on the part of the hammer price in excess of € 500.000 up to € 5.000.000 20,8%

on the part of the hammer price in excess of € 5.000.000 14,2%

plus 13% VAT with paintings or 20% VAT with antiques Please note that these fees exclude any import VAT in the state of destination in case of an export.

Additional fees apply on external online bidding platforms:

8) Buyer’s Commission on bids after the auction (post-auction sale): 35%

9) Terms of payment: Items purchased in an auction are payable within 8 days – either in cash or debit card – during our opening hours or by transfer. You can also use your credit card to pay for the works you bought at the auction. We charge an administrative fee of 2% of the purchase price for credit card payments.

10) Droit de suite: Objects marked with an asterisk * in the catalogue are subject to droit de suite in addition to the purchase price.

Droit the suite is calculated as a percentage of the highest bid as follows: 4% of the first € 50,000,

3% of the next € 150,000,

1% of the next € 150,000,

0,5% of the next € 150,000 and

0.25% of the remaining amount (i.e. over € 500.000),

but not exceeding a total sum of € 12,500. Droit de suite does not apply to highest bids below € 2,500.

11) Jurisdiction: All privities of contract between the bidder and the auction house underlie the rules of procedure of Auktionshaus im Kinsky GmbH. In making a bid the bidder confirms to know and to accept the rules of procedure. The rules of procedure can be viewed on our Website www.imkinsky.com. We can also send you the rules of procedure upon request. Place of fulfilment and of jurisdiction is Vienna. Austrian law applies.

12) General information The Auction House reserves the right to request a deposit, bank guarantee or comparable other security in the amount of 10% of the upper estimate. All bank transfers are to be made free of charge for the Auction House. The Auction House assumes no liability for any errors, technical services, breakdown, or failure of the Internet and Telephone connection.
